5. PURCHASES AND PAYMENT

17. CAPACITY SOLUTION
Informal negotiations
In order to expedite the resolution of disputes, disagreements or claims (each a "Dispute" and collectively a "Dispute") initiated by you or us (individually a "Party" and collectively the "Parties") and to control costs, the Parties agree to first attempt to resolve all Disputes (other than disputes expressly set forth below) shall be negotiated informally at least seven (7) days prior to commencement of arbitration. Such informal negotiations begin when one party has notified the other in writing.
Binding arbitration

Exceptions to informal negotiations and arbitration
The parties agree that the informal binding arbitration procedures mentioned above shall not apply to the following disputes: (a) disputes seeking to enforce or protect a party's intellectual property rights or their validity; (b) any disputes relating to or arising out of claims of theft, piracy, privacy or unauthorized use; and (c) any requirements for an injunction. If this provision is found to be illegal or unenforceable, neither party will elect to arbitrate any dispute covered by the portion of this provision that is found to be illegal or unenforceable, and such dispute will be resolved by a court of competent jurisdiction listed accordingly. with the foregoing jurisdiction, and the parties agree to submit to the personal jurisdiction of such court.

The Services may contain typographical errors, inaccuracies or incomplete information, including descriptions, pricing, availability and other information. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY. – BLOCKING WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT OF THE SERVICES, OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES, AND WE HAVE NO LIABILITY (1 OR LIABILITY) FOR THE RESPONSIBILITY.
